A man was convicted of murder based in part on the testimony of a driver who happened to be passing the scene. This re-enactment shows how unlikely that such an identification would be possible. In addition the the driver POV video, we also created a 3d model to investigate the affect of roadway configuration and roadside foliage on visibility.

The driver visited scene with police investigators and claimed to see defendant exiting bushes adjacent to house.

However, an 3d model of scene with accurate roadway and foliage conditions shows that this claim is inaccurate.

If he did in fact see someone near the scene, that person would have needed to be much closer to the road.

From a driver's point of view that person would still appear to "come out of the bushes" due to the rapidly changing position of the vehicle moving at 30 miles per hour.
